Legislator-Zusammenfassung

KI-generiert

The Court of Cassation declared the appeal inadmissible because the appellant failed to specifically address the evidentiary findings made by the lower court. The appellant contested the liability judgment and the supporting evidence without engaging with the specific procedural issues raised by the appellate court. Consequently, the court ruled that the appeal did not meet the requirements for admissibility under the relevant criminal procedure code.

Legislator-Regeste

KI-generiert

Art. 616 cod. proc. pen.; An appeal against a criminal judgment is inadmissible if the appellant fails to specifically and logically challenge the evidentiary assessment and procedural issues raised by the court of first instance.
