Legislator-Zusammenfassung

KI-generiert

The administrative authority sought to secure the repayment of social assistance benefits, totaling a significant amount, by placing a lien against the recipient's real estate because the recipient possessed property and refused to sign a repayment obligation. The court ruled that while a repayment obligation facilitates enforcement, the compulsory securing of the claim through a mortgage lien without the recipient's consent is impermissible. Consequently, the prior determination of the repayment amount, which was solely for the purpose of the now unenforceable lien security and not for ordering an enforceable repayment, had no legal effect, and the appeal against the order securing the claim was dismissed.

--- · --- · --- · Geschäftsnummer: · VB.2005.00219 · Entscheidart und -datum: · Endentscheid vom 15.09.2005 · Spruchkörper: · 3. Abteilung/3.
