Public Procurement: Permissibility and Limitation of Apprentice Training as Award Criterion
Legislator-Zusammenfassung
KI-generiertIn a public procurement case concerning building police and engineering services, the court addressed the permissibility of using apprentice training as an award criterion. The court determined that while using apprentice training is generally permissible, it must be weighted with a maximum of 10% of the total award criteria and must not lead to discrimination against foreign providers, specifically prohibiting its application against providers from WTO member states that lack comparable vocational training systems. Furthermore, only already filled apprenticeships may be considered, or those reliably expected to be filled, leading to the rejection of the appeal.
Legislator-Regeste
Abweisung (E. 5).
