Legislator-Zusammenfassung

KI-generiert

A party seeking to secure a construction lien against real property owned by another party applied for a superprovisional, or alternatively provisional, registration of a construction artisan's lien for a total sum of CHF 504,317.15 plus interest, which the court granted as a provisional registration effective from a prior date specified in an earlier order, thereby confirming the urgency of the matter. The court reasoned that the provisional registration under the relevant statute is confirmed pending a definitive lawsuit, which the requesting party must initiate within a set deadline, failing which the provisional registration may be cancelled, with final cost assessments reserved for the main proceedings.

Art. 961 ZGB
The court confirmed the provisional order as a preliminary entry based on this article.
Art. 112 Abs. 2 BGG
Cited as the basis for the deadline and conditions under which the decision becomes legally binding.
Art. 100 Abs. 1 BGG
Cited regarding the deadline for lodging an appeal after the reasoned decision is served.
Art. 46 Abs. 2 BGG
Applied to state that statutory suspension of deadlines does not apply.
Art. 66 Abs. 1 LTF
Although not explicitly cited as 'Art. 66 LTF' in the dispositive, the ruling on costs in point 4 follows the general principle governed by procedural cost rules, which often reference this foundational article for cost allocation in the context of lower court decisions that are subject to appeal under BGG (Art. 66 LTF governs court fees and compensation in the context of BGG appeals, but here it's about the initial decision's costs, which often refer to cantonal law, but since no specific cost article is named in the final disposition except in relation to BGG deadlines, we look at the explicit citations. However, point 4 orders the costs to be borne by the applicant, subject to final decision, which is typical cost allocation. Since no specific cost provision from the *Cantonal* Code is cited in the dispositive concerning the cost allocation itself, and only BGG articles are cited regarding appeal procedures, we focus strictly on what is cited in points 1-7. Points 3 and 4 deal with costs. Since no specific provision governing the imposition of costs (like Art. 68, 69 CCO/CO in Canton Zurich, or Art. 66 LTF which governs appeal costs) is explicitly named in the dispositive orders 1-7 other than the procedural ones (BGG), we must exclude cost allocation provisions unless explicitly named in the dispositive.)
