Compulsory Care Placement Appeal Timeline Exemption for Second Instance Court
Legislator-Zusammenfassung
KI-generiertThe case concerned the procedural timeline for a decision regarding compulsory care placement following an appeal. The court reasoned that the statutory requirement under Article 450e paragraph 5 of the Civil Code, mandating a decision within five working days of receiving the appeal in matters of compulsory care, does not apply to the second cantonal instance, which is the appellate court. The court further held that necessary delays resulting from comprehensive expert assessments ordered by the appellate court are unavoidable and reasonable, especially when the appellant themselves criticized the sufficiency of the prior assessment, justifying the prioritization of a thorough review over an immediate decision, while affirming that the general acceleration requirement was otherwise upheld.

Fall-Nr.: KES.2013.22 Stelle: Kantonsgericht Rubrik: Zivilkammern (inkl. Einzelrichter)
Publikationsdatum: 15.05.2014 Entscheiddatum: 15.05.2014
