Individual's Right to Propose Guardian
Legislator-Zusammenfassung
KI-generiertUnder Article 401, Paragraph 1 of the Civil Code, if an individual proposes a trusted person for guardianship, the court must appoint that person if they are suitable and willing to take on the role, and it is not necessary for them to be the most suitable candidate among all possibilities. The guardianship authority has a duty to inform the individual of their right to propose a guardian, and failure to do so constitutes a formal denial of justice, as the law now prioritizes the individual's right to self-determination more heavily.

Art. 401 Abs. 1 ZGB;
