The Administrative Court of Vienna (VwGH) declared the deadline-setting application moot, discontinued the proceedings, and ordered the Federal Republic of Austria to reimburse the applicant EUR 793.20 in costs. The dispute concerned a motion to set a deadline for the lower administrative court to issue a decision, filed after the lower court had already rendered its judgment on October 17, 2017. The VwGH determined that because the lower court had already fulfilled its decision-making obligation by the time the documents were submitted to the appellate court, the request for a deadline was rendered unnecessary. The court based its procedural ruling on § 38(4) first sentence of the Administrative Court Act (VwGG) in connection with § 33(1) VwGG, and awarded costs pursuant to §§ 47 et seq. and § 56(1) second sentence VwGG in conjunction with the VwGH Cost Reimbursement Ordinance 2014.
