Mootness of invalidity pension revision following concurrent annulment of remand order
Legislator-Zusammenfassung
KI-generiertThe Verwaltungsgerichtshof (VwGH) declared the appellant's ordinary revision moot and discontinued the proceedings, ordering the medical chamber to reimburse the appellant EUR 1,346.40 in costs. The dispute concerned the denial of an invalidity pension application under the Physicians Act 1998 and the chamber's welfare fund statutes; the Administrative Court for Lower Austria had initially annulled the denying administrative act and remanded the case, a decision that was subsequently annulled by a separate VwGH judgment based on a revision filed by the administrative authority. This concurrent annulment rendered the appellant's revision moot because it resulted in the appellant being left without a claim (Klaglosstellung), leading to the procedural termination of the current case. The legal basis for the discontinuation was § 33 Abs. 1 VwGG (mootness), while the cost allocation relied on § 55 and § 47 Abs. 2 Z. 1 VwGG in conjunction with the VwGH Expense Reimbursement Ordinance.
