Legislator-Zusammenfassung

KI-generiert

The Administrative Court declared the revision moot and discontinued proceedings, ordering the state to reimburse the applicant EUR 1,106.40 in costs. The dispute concerned the denial of the applicant’s status as an asylee by the Federal Administrative Court, which had rejected the initial complaint. The revision became moot because the Constitutional Court had previously set aside the impugned administrative decision, rendering the lower court’s ruling legally non-existent. The procedural termination was based on § 33 Abs. 1 first sentence of the Administrative Court Act (VwGG), which mandates the declaration of a revision as moot when the petitioner is formally discharged from the claim due to the annulment of the challenged decision, while the cost award relied on §§ 47 ff, specifically § 55 VwGG in conjunction with the 2014 Administrative Court Expense Reimbursement Ordinance.

Volltext
