Dismissal of deadline-setting application due to prior decision by Federal Administrative Court
Legislator-Zusammenfassung
KI-generiertThe Administrative Court dismissed the petition by dismissing the proceedings pursuant to § 38 para. 4 sentence 2 and § 15 para. 4 of the Administrative Court Act, as the Federal Administrative Court had properly issued and submitted the decision on the deadline-setting application; consequently, the court ordered the Federal Republic of Austria to reimburse legal costs of EUR 553.20 to the second applicant (who had been granted legal aid) and EUR 793.20 each to the remaining applicants. The dispute concerned a petition for a deadline-setting decision regarding administrative proceedings, and the court found that the Federal Administrative Court’s submission of the decision and proof of service rendered the VwGH’s review moot. The decision was based on the provisions of §§ 47 ff, particularly § 56 para. 1 sentence 2 of the Administrative Court Act, in conjunction with the VwGH Cost Reimbursement Ordinance 2014.
Legislator-Regeste
KI-generiert§ 38 Abs. 4 letzter Satz VwGG; § 15 Abs. 4 VwGG; The procedure for setting time limits is terminated when the Federal Administrative Court has already issued a decision, and the state must reimburse the applicant's legal costs.
