The appellant successfully appealed the first-instance court's dismissal of a discovery action regarding a utility easement. The court found the lower court erred in rejecting the action because the Energy Act explicitly permits such claims without requiring proof of legal interest. Consequently, the appellate court vacated the first-instance decision and remanded the case for further proceedings.

VSL sodba II Cp 126/2009
Appellate court dismisses appeal upholding easement via transitional rule and good faith possession. The court ruled that the 10-year prescriptive period began under the old law and matured upon the new law's enactment. The court rejected the claim that lack of registration interrupted the prescriptive period due to the parties' long-standing knowledge of the easement. The decision clarifies that good faith possession under the old law can mature into a servitude under the new law. The court held that the parties' knowledge of the easement prevents them from claiming interruption of the prescriptive period. The court found that the lack of registration does not protect the parties from the consequences of the prescriptive period. The court determined that the parties' knowledge of the easement prevents them from claiming interruption of the prescriptive period. The court held that the parties' knowledge of the easement prevents them from claiming interruption of the prescriptive period.

Pritožbi se ugodi in se sklep sodišča prve stopnje razveljavi.

[JEDRO]

3. V pravočasni pritožbi zoper sklep o zavrženju tožbe tožeča stranka uveljavlja pritožbene razloge bistvene kršitve določb pravdnega postopka, zmotne in nepopolne ugotovitve dejanskega stanja ter zmotne uporabe materialnega prava. Predlaga razveljavitev sklepa in vrnitev zadeve sodišču prve stopnje v nadaljnje postopanje. Bistvene pritožbene navedbe bodo povzete v nadaljevanju, ko bo nanje sproti odgovorjeno.

4. Pritožba je utemeljena.

člen in 354. člen ZPP).
