The Supreme Court of the Republic of Slovenia rejected the defendant's request for leave to appeal the first-instance judgment. The lower court upheld an enforcement order requiring the defendant to pay 3,318.12 EUR plus interest to the plaintiff. The defendant argued that the first instance court erred by issuing a judgment based solely on the file status without meeting statutory conditions under Article 282 of the Civil Procedure Act. The Supreme Court found the request unfounded because the conditions for granting leave of appeal under Article 367.a of the Civil Procedure Act were not met.

[JEDRO]

Predlog se zavrne.

[OBRAZLOŽITEV]

člena Zakona o pravdnem postopku (v nadaljevanju ZPP). Zatrjuje še kršitve razpravnega načela in 8. člena ZPP (pravico do izjave toženca) v povezavi z določbami 7., 8. in 12. člena ZPP.

4. Predlog ni utemeljen.

5. Pogoji za dopustitev revizije iz prvega odstavka 367.a člena ZPP niso podani, zato je Vrhovno sodišče toženčev predlog zavrnilo (drugi odstavek 367.c člena ZPP).

6. Vrhovno sodišče je odločalo v senatu, navedenem v uvodu sklepa. Odločbo je sprejelo soglasno (sedmi odstavek 324. člena ZPP).
