Legislator summary

AI generated

The appeal court dismissed the appeal, upholding the first-instance court's decision that the debtor's objection was deemed withdrawn due to non-payment of the court fee. The debtor argued the fee was unpaid because they contested its amount, but this claim was irrelevant as the fee assessment was already final. The court ruled that under Article 29b of the Enforcement and Security Act, an objection is considered withdrawn if the fee is not paid within the statutory period and no conditions for exemption or deferral are met.

VSL Sklep II Cpg 935/2018
Appeal dismissed; bank account freeze does not excuse late court fee payment under ZPP Art. 105a(3).
VSL sklep II Cpg 1263/2015
Appeal dismissed; court upheld first instance ruling that withdrawal of appeal was valid due to unpaid court fees. The appeal was rejected because the defendant failed to pay court fees within the deadline, and the court correctly deemed the appeal notice withdrawn. The court rejected the defendant's attempt to overturn the presumption of service based on the delivery certificate, as such presumptions cannot be easily rebutted without substantial evidence. The decision emphasizes that procedural deadlines for fee payment are strict and that the burden of proof lies with the party claiming non-service. The court ruled that the first instance court acted correctly in finding the appeal notice withdrawn due to non-payment. The appeal was dismissed because the defendant could not provide sufficient evidence to challenge the validity of the service notice. The court held that the presumption of service via delivery certificate stands unless strongly contradicted by evidence. The defendant's claim of non-service was rejected due to lack of specific factual arguments and supporting documentation. The court confirmed that the first instance court's decision to treat the appeal as withdrawn was legally sound. The appeal was dismissed because the defendant failed to meet the statutory requirements for challenging the service of the appeal notice.

I. Pritožba se zavrne in se potrdi izpodbijani sklep sodišča prve stopnje.

II. Upnik sam krije svoje stroške tega pritožbenega postopka.

[JEDRO]

člena Zakona o pravdnem postopku (ZPP) v zvezi s 366. členom ZPP in 15. členom Zakona o izvršbi in zavarovanju (ZIZ).

členom ZPP in 15. členom ZIZ, je bilo potrebno pritožbo zavrniti kot neutemeljeno in potrditi izpodbijani sklep sodišča prve stopnje (2. točka 365. člena ZPP v zvezi s 15. členom ZIZ).

11. Upnik sam krije svoje stroške tega pritožbenega postopka, saj odgovor na pritožbo ni bil potreben, ker v njem upnik ni navedel ničesar, kar bi pripomoglo k vsebinski odločitvi sodišča druge stopnje (peti odstavek 38. člena ZIZ).

1 S sklepom z dne 9. 11. 2020 je sodišče prve stopnje odločilo o prekinitvi postopka in nadaljevanju postopka z novim upnikom.
