The court dismissed the appeal against the first-instance decision to terminate the guardianship proceedings due to the ward's death. Consequently, the court ruled that asset protection must be handled through inheritance proceedings rather than guardianship.

Sklep VIII Ips 172/2012
Supreme Court dismisses revision against final termination order, ruling it does not end proceedings. The court held that a rejection of a request to restore previous status does not conclude the legal process. Consequently, the Supreme Court rejected the revision filed against the second-instance court's final decision. The court clarified that the procedural process ended with the termination order, not the subsequent rejection of the restoration request. The applicant's reliance on a later constitutional court decision was deemed irrelevant to the current procedural stage. The court emphasized that only the termination order constitutes the final conclusion of the proceedings. Therefore, the revision was inadmissible as it targeted a non-final procedural step. The decision reinforces the distinction between procedural termination and interim procedural rulings. This ruling ensures clarity in the hierarchy of procedural steps and finality of termination orders.
