Legislator summary

AI generated

The Supreme Court of Slovenia transferred jurisdiction from the Ljubljana District Court to the Kranj District Court because the defendant was a judge at the original court. The plaintiff sued both the state and the specific judge, prompting the Ljubljana court to request a transfer to avoid apparent bias. The court ruled that the defendant's position as a judge at the presiding court constituted a significant reason for transferring jurisdiction under the Code of Civil Procedure.

67. člen Zakona o pravdnem postopku; ZPP: The Supreme Court may transfer jurisdiction to another competent court when it is evident that the proceedings would be easier conducted or for other significant reasons, such as circumstances that could undermine the appearance of impartiality before an average observer, including when the defendant is a judge of the court that would normally preside.
