Po določbi prvega odstavka 34. člena Zakona o upravnem sporu (ZUS-1), lahko tožeča stranka umakne tožbo brez privolitve tožene stranke do pravnomočne odločitve. Po drugem odstavku 34. člena ZUS-1 sodišče postopek s sklepom ustavi.

[OBRAZLOŽITEV]

1. Tožeča stranka je pri Upravnem sodišču Republike Slovenije v Ljubljani dne 11. 9. 2018 vložila tožbo zoper toženo stranko, s katero je izpodbijala v uvodu navedeno odločbo. Dne 15. 4. 2019 pa je tožeča stranka s pisno vlogo izjavila, da tožbo umika.

2. Po določbi prvega odstavka 34. člena Zakona o upravnem sporu (ZUS-1), lahko tožeča stranka umakne tožbo brez privolitve tožene stranke do pravnomočne odločitve. Po drugem odstavku 34. člena ZUS-1 sodišče postopek s sklepom ustavi, kot je ravnalo v obravnavanem primeru. Sorazmerni del sodne takse bo tožeči stranki vrnjen na fiduciarni račun pooblaščenca, ki ga je navedla v vlogi o umiku tožbe.
