I. Zamudna sodba se razveljavi in se tožba tožeče stranke z dne 15. 9. 2017 zavrže.

II. Vsaka stranka sama krije svoje pravdne stroške.

Ker sta pravdni stranki sklenili sodno poravnavo, je pritožbeno sodišče razveljavilo zamudno sodbo in zavrglo tožbo.

[OBRAZLOŽITEV]

Pravdni stranki sta v tej zadevi 21. 12. 2018 sklenili sodno poravnavo in pritožbenemu sodišču predlagali, da razveljavi izpodbijano zamudno sodbo in tožbo tožeče stranke zavrže. Na podlagi 308. čl. Zakona o pravdnem postopku je pritožbeno sodišče njunemu predlogu ugodilo, v skladu s poravnavo in predlogom obeh strank pa vsaka stranka sama krije svoje pravdne stroške.
