The Higher Court in Ljubljana dismissed the appeal, determining that the Okrajno sodišče (District Court) in Ljubljani holds exclusive jurisdiction over the case. The appellant, a chamber of commerce, argued for district court jurisdiction, but the court found it did not qualify as a 'business entity' under Article 481 of the Civil Procedure Act. Consequently, the matter does not constitute a business dispute, and the general rule assigns jurisdiction to the District Court based on the value of the subject matter.
