Legislator summary

AI generated

The court dismissed the appeal filed by a dissolved bankruptcy administrator against a first-instance judgment. The administrator argued that the bankruptcy process was concluded and the debtor ceased to exist, yet the court found the administrator lacked procedural standing. Since the administrator's authority to represent the debtor terminates upon the conclusion of the bankruptcy process, they cannot act as a plaintiff in the appeal.

VSL sklep II Cp 2189/2016
Appeal dismissed; Article 367 of Obligations Act protects only limitation periods, not preclusion periods. The court ruled that the deadline to sue for contract formation is a preclusion period, not a limitation period. The appeal was rejected because the lower court correctly applied the law regarding the nature of the deadline. The plaintiff argued that the deadline should be a limitation period to allow for transfer of jurisdiction, but the court held that Article 367 of the Obligations Act only protects limitation periods, not preclusion periods. The court decided as it did because the plaintiff's arguments regarding the distinction between limitation and preclusion periods were not supported by the relevant legal provisions. The appeal was dismissed, and the lower court's decision was confirmed. The plaintiff and defendant each bear their own costs of the appeal proceedings. The court ruled that the deadline to file a lawsuit for the conclusion of the main contract is a preclusion period, not a limitation period. 1. Pritožba se zavrže.

2. Četrto in peto toženca sama nosita stroške pritožbenega postopka.

[JEDRO]

To pooblastilo preneha s končanjem stečajnega postopka in razrešitvijo stečajnega upravitelja.

To pooblastilo preneha s končanjem stečajnega postopka in razrešitvijo stečajnega upravitelja (prim. 376.

7. Odgovor na pritožbo četrtega in petega toženca ni prispeval k odločitvi o pritožbi in je bil v tem smislu nepotreben (prim. 1. odstavek 155.
