Supreme Court dismisses appeal permission request due to missing final lower court judgment attachment.
Legislator summary
AI generatedThe Supreme Court of Slovenia dismissed the applicant's request for permission to appeal because the final judgment from the second-instance court was not attached to the submission. The applicant submitted a request for review permission on January 8, 2016, but failed to include the required copy of the legally binding decision from the Higher Labour and Social Court dated November 26, 2015. The court rejected the request because Section 367b(3) of the Act on Civil Procedure Law mandates this attachment, and Section 367b(6) provides for the automatic rejection of non-compliant requests.
