The Court of Appeal granted the appeal, quashing the first-instance judgment for lack of reasoning and ordering a new trial. The defendant argued that the lower court violated procedural rules by failing to inform them of their right to appeal under Article 324(4) of the Civil Procedure Act. The court ruled that a judgment with abbreviated reasoning must explicitly notify the party of their right to appeal, and the failure to do so constituted a fundamental procedural violation requiring the case to be remanded.

VSL sodba I Cpg 837/2015
Appeal dismissed because the appeal lacked the appellant's handwritten signature, rendering it incomplete and inadmissible under ZPP. The court ruled that without a signature, the appeal is void and cannot be substantively reviewed. The decision emphasizes the strict statutory requirement for a handwritten signature to validate an appeal. The court ordered the respondent to pay the appellant's appeal costs. The appeal was rejected due to the missing signature, which made it procedurally invalid. The court held that a handwritten signature is a mandatory requirement for a valid appeal. The court dismissed the appeal and awarded costs to the respondent. The appeal was rejected because it lacked the necessary handwritten signature. The court found the appeal incomplete and inadmissible due to the missing signature. The appeal was dismissed as it failed to meet the statutory signature requirement. The court ruled that the missing signature rendered the appeal void and inadmissible.

I. Pritožbi se ugodi, izpodbijana sodba se razveljavi in se zadeva vrne sodišču prve stopnje v nov postopek.

II.

[JEDRO]

Sodba s skrajšano obrazložitvijo mora vsebovati pravni pouk o napovedi pritožbe.

[OBRAZLOŽITEV]

1. V izpodbijani sodbi je sodišče prve stopnje sklep o izvršbi Okrajnega sodišča v Ljubljani opr. št. VL 143315/2013 z dne 11. 9. 2013 vzdržalo v veljavi v 1. in 3. točki izreka in na podlagi določila 496. člena ZPP izdalo sodbo brez obrazložitve.
