Ugotovi se, da je tožena stranka pritožbo umaknila.

[JEDRO]

Sklep o umiku pritožbe je izdalo sodišče druge stopnje, ker v zadevi še ni izdalo odločbe o pritožbi in ker umika pritožbe ni mogoče preklicati.

[OBRAZLOŽITEV]

1. Z vlogo z dne 30. 8. 2013 je stečajni upravitelj kot zakoniti zastopnik tožene stranke v stečaju, umaknil pritožbo zoper uvodoma citirano sodbo.

2. Sklep o umiku pritožbe je izdalo sodišče druge stopnje na podlagi določbe 334. člena ZPP, ker v zadevi še ni izdalo odločbe o pritožbi in ker umika pritožbe ni mogoče preklicati (3. odstavek 334. člena ZPP).
