Legislator summary

AI generated

The Supreme Court of Slovenia rejected a defendant's request to transfer a civil case from the District Court in Velenj to the District Court in Celj. The defendant argued that merging the proceedings would be efficient, but the court found the request invalid because the two courts do not share the same subject-matter jurisdiction. Consequently, the court ruled that delegation based on procedural efficiency is only permissible when the courts involved possess identical jurisdictional authority.

Article 67 of the Civil Procedure Act; Delegation of proceedings between courts of different subject-matter jurisdiction is impermissible, as efficiency alone cannot override the requirement for identical jurisdictional authority.

[JEDRO]
