Request for transfer of jurisdiction dismissed for failure to pay judicial stamp duty
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the petition for the transfer of jurisdiction filed by a monastery, ruling that the plaintiff did not comply with the mandatory obligation to pay the judicial stamp duty. The dispute arose from a request to remand civil case No. 2437/321/2012 from the Neamț Court of Appeal, where the proceedings had been suspended; although the plaintiff’s counsel submitted evidence of payment after being cited with the duty to remit specific fees, the Public Prosecutor represented the state’s interest in rejecting the transfer due to the initial failure to conform to the legal obligation. The court’s decision rested on the procedural requirement of Article 40 of the Code of Civil Procedure regarding the suspension of trials and the strict legal obligation to settle judicial fees before a request for jurisdictional transfer can be granted, resulting in a final order with no avenue for appeal.
