Eviction action: High Court declined jurisdiction and referred case to County Court after recharacterizing defendant's appeal
Legislator summary
AI generatedThe High Court of Cassation and Justice declined jurisdiction, referring the case to the Brașov County Court as the competent appellate instance, with no further appeal available against this procedural decision. The dispute involved a civil action for the eviction of multiple defendants from a residential property in Brașov, where the first-instance court had granted the plaintiff's request against most defendants but dismissed it against one specific defendant who subsequently filed an objection. The decisive legal basis was the recharacterization of the defendant's "appeal" (recurs) into a standard "appeal" (apel) under Article 1041(5) of the New Code of Civil Procedure, which restricts challenges to first-instance eviction orders to appeals only; consequently, pursuant to Articles 466, 95(2), and 96(2) of the same code, the High Court lacked material competence to hear the matter, which falls exclusively within the purview of the hierarchically superior court, i.e., the County Court.
