Waiver of civil appeal in commercial proceedings and acceptance of renunciation under Art. 247 of the Code of Civil Procedure.
Legislator summary
AI generatedThe High Court of Cassation and Justice accepted the appellant's waiver of the appeal, thereby leaving the lower court's decision in force and final. The case involved a commercial dispute where the Court of Appeal had previously dismissed a request to refer an unconstitutionality exception regarding the admissibility conditions for constitutional challenges (specifically whether the contested legal provision was relevant to the case) to the Constitutional Court. The appellate court had rejected the exception on the grounds that the statutory link between the challenged provision and the resolution of the case was not established. On appeal, the appellant did not allege any new grounds of illegality but instead waived its right to the judicial review of the appeal. Relying on the provision of the Code of Civil Procedure permitting the waiver of rights without the counterparty's consent, the Court formally noted the waiver and refused to examine the merits of the appeal, rendering its decision irrevocable.

Asupra recursului de față;
Împotriva acestei decizii, reclamanta SC H.T.
