S-a luat în examinare cererea de strămutare formulată de petenta H.M.

La apelul nominal lipsesc părțile, respectiv petenta H.M., și intimații H.M. și H.S.

Ministerul Public este reprezentat de procuror Ș.S.

Procedura de citare este legal îndeplinită.

Se referă de magistratul asistent asupra faptului că dosarul a cărui strămutare se cere are termen de judecată la data de 17 ianuarie 2013, precum și asupra faptului că petenta H.M. a depus cerere de renunțare la judecată, prin fax, la data de 22 noiembrie 2012.

Procurorul solicită, în principal, să se ia act de cererea de renunțare la judecată în măsura în care aceasta îndeplinește condițiile prevăzute de lege, iar în subsidiar, pune concluzii de respingere a cererii de strămutare.
