Legislator summary
AI generatedThe High Court of Cassation and Justice accepted the withdrawal of the appeal filed by a defendant against the Court of Appeal’s prior decision, rendering the appellate dismissal of the defendants' previous appeals definitive. The dispute concerned a procedural ruling by the Bucharest Court of Appeal, which had rejected the defendants' appeals against a trial court session order; upon the defendant's personal appearance and declaration of withdrawal, the Supreme Court formally recorded the act, leaving the lower court’s order in force. Citing the Criminal Procedure Code provisions allowing withdrawal before the closing of debates at the appellate level, the Court also ordered the withdrawing defendant to pay 200 RON in judicial costs to the state, noting that 100 RON for ex officio defense would be advanced from the Ministry of Justice fund.
