Denial of civil case transfer due to non-compliant waiver of judgment proceedings
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed the petition for case transfer filed by the applicant, upholding the jurisdiction of the original appellate court. The dispute concerned a request to transfer a civil case due to procedural irregularities, during which the court noted the case was suspended under Article 244(1)(1) of the Code of Civil Procedure; although the applicant filed a motion to waive the judgment of the transfer request, the court rejected this motion as procedurally non-compliant and proceeded to adjudicate the merits. Relying on the Ministry of Public's conclusion and its own analysis, the court found no basis to grant the transfer, rendering a final, non-appealable decision.
