Transfer of jurisdiction moot after final resolution of underlying civil case

The High Court of Cassation and Justice dismissed the petition for the transfer of jurisdiction (strămutare) filed by the applicant regarding a civil case originally pending before the Timiș Court of Appeal, with the decision final and subject to no appeal. The dispute concerned a procedural request to move the trial to a different court; however, the proceedings became moot because the record revealed that the underlying case had already been adjudicated and finalized on May 14, 2013. Based on the procedural doctrine that a motion for transfer of jurisdiction is rendered without object (rămasă fără obiect) once the substantive case is conclusively resolved, the court upheld the public prosecutor’s recommendation to reject the application due to the absence of a pending dispute requiring judicial oversight.
