Peremption of Civil Recourse Due to One-Year Inactivity Following Interruption of Proceedings
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the appeal dismissed and the lower court’s decision of May 14, 2003, irrevocable, as the appeal was barred from proceeding. The dispute involved civil litigants who challenged an appellate decision on grounds of illegality, alleging that the court had awarded relief not requested and misinterpreted the underlying legal act, while also criticizing contradictory reasoning. The Supreme Court determined that the appellate proceedings had been interrupted on May 28, 2007, and remained in a state of inactivity for more than one year due to the fault of the appellant, who failed to diligently pursue the resolution. Relying on Articles 248(1) and 252(1) of the Code of Civil Procedure, the Court concluded that the legal deadline for the appeal had expired, resulting in the automatic peremption of the recourse.
