The High Court of Cassation and Justice dismissed the counterclaim for legal costs and recorded the petitioner's withdrawal of the application for the transfer of a civil case, resulting in no party prevailing on substantive merits. The dispute involved a procedural incident where a party sought to transfer a civil litigation pending before a lower court tribunal to another instance due to impartiality concerns, but the petitioner subsequently waived the judgment of the transfer request without paying the required judicial fees. Relying on the principle of party disposition and Article 246 of the Code of Civil Procedure regarding the withdrawal of claims, the court noted that the transfer request constituted a procedural incident not affecting the merits of the underlying dispute; consequently, it held that Article 274(1) of the Code of Civil Procedure, which mandates cost awards based on the opponent's procedural fault, did not apply to such incidents, thereby denying the costs claimed by the opposing party.
