Transfer of venue granted: Case moved from Satu Mare to Cluj-Napoca court
Legislator summary
AI generatedThe High Court of Cassation and Justice (Civil Section) granted the plaintiff's petition for transfer of venue, ordering the case to be moved from the Satu Mare Court to the Cluj-Napoca Court and ruling that all procedural acts completed prior to the transfer remain valid; the decision is final and not subject to appeal. The dispute concerned a motion for transfer of jurisdiction (strămutare), where the plaintiff sought a change of forum for Case No. 11226/296/2011, with the defendant parties absent from the hearing. The court relied on the procedural framework governing the transfer of cases and the specific statutory provisions regarding the suspension of proceedings, noting that the previous judicial hearing had been suspended in June 2012 pending this decision.
