The High Court of Cassation and Justice declined material jurisdiction, ordering that the extraordinary appeal filed against a first-instance civil judgment be referred to the Gorj Court of Appeal, thereby leaving the underlying judgment and the prior dismissal of the main appeal unchanged pending a competent hearing. The dispute involved a property rights case under Law No. 18/1991 where the applicant, having lost at the first instance, was subject to a second-instance decision by the Gorj Court of Appeal that had dismissed the opposing parties' appeals and rejected the claim. The decisive legal basis was the violation of Article 319(1) of the Civil Procedure Code, which mandates that a contestation in cassation (contestație în anulare) be filed with the court that issued the attacked decision, necessitating the declination of jurisdiction under Article 158(3) C.P.C. because the appeal was incorrectly lodged with the High Court rather than the competent appellate court.
