The High Court of Cassation and Justice dismissed as unfounded the petitioner’s request to transfer the case (Dossier no. 9178/211/2006*) from the Cluj Court of Appeal to another equal court, ordering the petitioner to pay 100 RON in judicial costs to the state; the decision is final. The petitioner had sought the transfer under Article 55(1) of the old Code of Criminal Procedure, claiming that judicial impartiality could be compromised due to the case circumstances and the parties’ status, alleging that the assigned judges showed hostility by rejecting all exceptions and defense evidence requests and pressuring him and his counsel for a speedy trial. The court held that none of the statutory conditions for transfer—impaired judge impartiality due to case circumstances, local hostilities, parties’ status, risk of public disorder, or a party’s relative or in-law up to the fourth degree among judges, prosecutors, assistants, or clerks—were met, as the alleged grievances did not fall within the enumerated grounds; the case had also already been resolved on appeal at the January 21, 2013 hearing, and the Ministry of Justice’s information indicated no justification for transfer.

192 alin. (2) C. proc. pen.
