The High Court of Cassation and Justice dismissed the petitioner's application for the transfer of jurisdiction regarding a commercial case originally filed with the Cluj Commercial Court, thereby leaving the proceedings under the jurisdiction of the lower court. The dispute involved a request to relocate the trial, during which the procedural status of the case was complicated by a late-filed response to the case and an attempt by the petitioner to withdraw the action via fax and email; however, the Court refused to take cognizance of the withdrawal because the unauthenticated method of submission prevented the definitive identification of the party's intent. Relying on the procedural requirement for certainty in the exercise of dispositive acts, the Court ruled that the lack of verified identity in the withdrawal request precluded a ruling on the merits of that act, necessitating the examination and subsequent rejection of the jurisdictional transfer request instead.
