Transfer of jurisdiction petition annulled for failure to prepay judicial stamp duty
Legislator summary
AI generatedThe High Court of Cassation and Justice dismissed and annulled the petition for transfer of jurisdiction filed by the plaintiffs, ruling that the request was invalid due to non-compliance with stamp duty obligations. The case involved a procedural motion to transfer a civil lawsuit from the Bucharest Court of Appeal, but the petitioners failed to pay the required 4 RON stamp duty and 0.3 RON judicial stamp as instructed in their summons. Applying Article 20 of Law No. 146/1997 on judicial stamp duties, the court determined that taxes must be paid in advance and that failure to meet the payment deadline mandated by the established term results in the annulment of the action or request; consequently, the un-stamped petition was rejected without prejudice to the merits of the underlying transfer request.
