The High Court of Cassation and Justice (ICCJ) admitted the petition filed by the plaintiffs and ordered the transfer of jurisdiction for Case No. 1342/99/2012 from the Civil Section of the Iași Court of Appeal to the Brașov Court of Appeal, retaining all procedural acts previously undertaken, a final and unappealable decision. The dispute concerned a request for *strămutare* (transfer of a pending case), where the public prosecutor argued against the motion as unfounded, but the court considered the procedural posture, including the scheduled hearing date of January 18, 2013, and the timely submission of written conclusions and supporting documents by the plaintiffs via fax and postal service. The legal basis for the ruling rests on the procedural authority of the ICCJ to determine the competent court for hearing civil cases through the mechanism of transferring jurisdiction to ensure proper administration of justice, resulting in the displacement of the original court's competence in favor of the designated alternative appellate court.
