Failure to pay judicial stamp duty on petition for transfer of jurisdiction
Legislator summary
AI generatedThe Supreme Court of Cassation and Justice annulled the request for transfer of jurisdiction filed by the plaintiff, as it was not legally stamped. The dispute involved a procedural challenge by a limited liability company seeking to move a civil case from the Bucharest Court of Appeal to a different jurisdiction. The decisive legal basis for the annulment was Article 20(3) of Law No. 146/1997, which mandates the payment of the judicial stamp duty; the court found that the petitioner failed to fulfill this legal obligation to pay the required fee, rendering the request void, and the decision is final with no avenue for appeal.
