The High Court of Cassation and Justice dismissed the petitioner's request to transfer Case No. 7576/2/2012 from the Bucharest Court of Appeal to its own civil section, ruling in favor of the opposing party and the prosecutor who advocated for rejection. The dispute concerned a procedural motion to reassign a civil case pending appeal, where the petitioner alleged prior rejections by the first civil section and sought inclusion with another case in a different section, while the court noted the existence of a scheduled hearing for the underlying case. The court first dismissed a request for the recusal of all judges in the first civil section as inadmissible under Article 28(2) of the Code of Civil Procedure, as such collective recusal is not permitted, and subsequently denied the transfer request, finding that it was legally invested with jurisdiction and that no grounds existed to remove the pending case from its current docket.
