The High Court of Cassation and Justice recorded the appellants' withdrawal of their cassation appeal, rendering the appellate decision final and irrevocable, with no costs awarded as the respondent did not claim them. The dispute originated from a civil action challenging the amount of compensation established by a local council commission under Law No. 198/2004, where the lower courts dismissed the claim based on the exception of tardiness; specifically, the trial and appeal courts found that the plaintiffs filed their objection on January 15, 2010, significantly exceeding the 15-day statutory deadline calculated from the March 12, 2007 communication of the compensation decision. The appellants had argued on cassation that Article 9 of Law No. 198/2004 allowed them to choose between the 15-day period and a three-year period from the entry into force of Government Order No. 12/2007, but the substantive legal issue was not decided on the merits due to the withdrawal. The Court’s final order was grounded in Article 246 of the Code of Civil Procedure regarding the plaintiff’s right to renounce the judgment and the principle of party autonomy, resulting in the acceptance of the withdrawal of the appeal against the Court of Appeal decision.

Deliberând, în condițiile art. 256 alin. (1) C. proc. civ., asupra recursului de față;

și I.V.O.
