The High Court of Cassation and Justice resolved a negative conflict of jurisdiction by assigning the case to the Brașov Court of Appeal, rendering the decision irrevocable. The dispute concerned a challenge to an administrative decision regarding the recalculation of a pension issued by a state ministry's pension agency, which was initially filed with the Brașov Court of Appeal. Both the Brașov and Bucharest Courts of Appeal declined jurisdiction based on conflicting interpretations of civil procedure and labor/social insurance laws, leading to the referral to the supreme court. The court determined that the decisive legal basis was Article 154(1) of Law No. 263/2010, which established that competence lies with the court of appeal having territorial jurisdiction over the claimant's domicile or seat at the time the action was filed, thereby establishing the Brașov court as the competent forum.
