Peremption of appeal due to procedural inaction following suspension of proceedings
Legislator summary
AI generatedThe High Court of Cassation and Justice permanently enjoined the appeal filed by the defendant municipality, resulting in the appellate decision of September 27, 2005, becoming final and unchallengable. The dispute concerned the procedural status of a civil appeal against an appellate civil judgment, where the proceedings had been suspended in April 2006 and subsequently remained dormant for over four years without any procedural acts by either party to resume the trial. The Court applied Article 248(1) of the Code of Civil Procedure, determining that the one-year period for procedural inaction attributable to the parties' fault had elapsed without grounds for suspension or interruption, thereby satisfying the conditions for lapse. Consequently, pursuant to Article 312(1) of the Code of Civil Procedure, the Court declared the appeal lapsed (perimat), restoring the finality of the lower court's ruling.
