Appeal perished for moral damages claim against State and Ministry of Justice for 1952 political conviction
Legislator summary
AI generatedThe High Court of Cassation and Justice declared the plaintiff's appeal as perished, thereby leaving in force the lower courts' rulings that dismissed the claim; the plaintiff lost the case entirely. The dispute involved a civil action for moral damages against the State and the Ministry of Justice for an alleged unjust political conviction by a military tribunal in 1952, which was initially rejected by the first-instance court due to lack of passive standing for one defendant and meritless claims against the other, and subsequently upheld on appeal. The decisive legal basis was procedural: because the appellant failed to appear at the scheduled hearing without invoking the right to postpone and allowed the case to remain inactive for over a year through his own fault, the court applied provisions of the Code of Civil Procedure regarding the lapse of time limits (peremption) to terminate the appellate proceedings.

248 C. proc. civ., Înalta Curte va constata, conform art. 252 C. proc. civ., că prezentul recurs este perimat.
