The High Court of Cassation and Justice (Criminal Section) rejected as unfounded the petitioners' request to transfer the trial of their case from the Vatra Dornei District Court to another court of equal rank, and ordered each petitioner to pay 50 RON in judicial costs to the state; the decision is final and leaves the original forum in place. The petitioners, who were private complainants in a criminal case challenging the prosecutor's orders to drop charges (under criminal procedure for complaints against non-indictment orders), sought the transfer claiming legitimate suspicion of judicial bias because two respondents included active and former local police officers and because of the seriousness of the alleged facts, including unlawful deprivation of liberty. The court held that the invoked grounds did not fall within the exhaustive list of transfer grounds under Article 55 of the former Criminal Procedure Code (as amended by Law No. 356/2006), and no substantive reasons justifying transfer were established; costs were imposed under Article 192(2) of the same code.

Asupra cererii de strămutare de față;

și M.A.I.

Văzând și dispozițiile art. 192 alin. (2) C. proc. pen.;
