The High Court of Cassation and Justice dismissed as inadmissible the petitioner’s appeal against the Bucharest Court of Appeal’s judgment of 6 December 2010, which had already rejected as tardy the petitioner’s complaint (under art. 278¹ of the former Criminal Procedure Code) against a prosecutor’s order not to start a criminal investigation; the Court upheld the lower decision and ordered the petitioner to pay 200 RON in costs. The dispute concerned the denial of the petitioner’s application to challenge the prosecutor’s refusal to prosecute two police officers. The decisive legal basis was the transitional rule in art. XXIV(1) of Law No. 202/2010, which applies new procedural rules according to the date of the first judgment sought to be appealed; because that judgment post-dated the law’s entry into force, the amended art. 278¹(10) applied, rendering the first-instance decision final and subject to no appeal, thereby making the recourse inadmissible.
