The High Court of Cassation and Justice ordered the case to be referred to the Bucharest Court of Appeal, Civil and Administrative Section, to resolve the dispute, thereby determining that the Court of Appeal was the competent jurisdiction for the final decision. The dispute concerned a motion for revision of judicial decisions issued by a first-instance court and a court of appeal, based on the existence of contradictory final judgments between the same parties in the same litigation. Applying Article 137(1) of the Civil Procedure Code to address procedural exceptions first, the court relied on Article 323(2) of the Civil Procedure Code, which mandates that a revision request under Article 322(7) regarding contradictory judgments must be directed to the court of higher degree than the instances that pronounced the conflicting rulings; consequently, because the challenged judgments originated from the lower courts, the Bucharest Court of Appeal was identified as the proper forum for adjudication.

Ținând cont de dispozițiile art. 137 alin. (1) C. proc. civ., conform cărora instanța se va pronunța mai întâi asupra excepțiilor de procedură și de fond care fac inutilă cercetarea fondului pricinii;

Asupra excepției de necompetență de față;

Or, potrivit art. 323 alin. (2) C. proc. civ., "În cazul art. 322 pct.
