Recusal of appellate court dismissed as moot after underlying civil case already adjudicated

The High Court of Cassation and Justice dismissed the applicant's request for the recusal of the Court of Appeal Iași, leaving the prior procedural status of the underlying civil case unchanged. The dispute concerned a procedural motion to transfer jurisdiction for Case No. 8035/99/2010, which the applicant argued required recusal, but the Public Prosecutor successfully argued the motion had become moot ("remained without object") because the record showed the case had already been adjudicated on May 11, 2012. The decisive legal basis for the decision was the mootness of the procedural request, rendering it unnecessary for the court to exercise jurisdiction over the recusal petition as the subject matter of the request had already been resolved.
