The High Court of Cassation and Justice dismissed the motion for transfer of jurisdiction filed by a limited liability company, leaving the civil proceedings pending before the Constanța Tribunal in force; the case involved a request to relocate civil docket No. 12531/118/2011, with the Public Ministry opposing the transfer on the grounds that the scheduled hearing date was sufficiently proximate and the procedural requirements for such a measure were not met. The decisive legal basis was the requirement that a motion for transfer must demonstrate specific impediments or risks to impartial justice that cannot be addressed by the current tribunal, which the petitioner failed to substantiate, resulting in the rejection of the transfer request without appeal.
