Transfer motion rejected as moot after underlying case already resolved

The High Court of Cassation and Justice (Civil Section I) rejected as moot the request to transfer case file no. 19337/197/2011 from the Brașov District Court, filed by the petitioner, because the case had already been resolved per the court’s electronic case-tracking system; accordingly, the court dismissed the transfer motion with no further appeal available, leaving the prior resolution of the underlying case in force. The dispute concerned a procedural motion for a change of venue under Romanian civil procedure, and the decisive basis was that the transfer request had become devoid of object once the underlying case was finally adjudicated.
